Your Agreement with Grayson Martello-Livingston & Martello Travel:

Before finalizing arrangements for your trip, Martello Travel requires that you (the “Client”) check the box stating “I agree to the terms and conditions of Your Agreement with Martello Travel” on an engagement/liability letter, thereby signifying agreement with the following terms and conditions.

AGENT FOR SUPPLIERS:

Martello Travel acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in the Client’s itinerary (“Suppliers”). The client consents to the use of Suppliers and agrees not to hold Martello Travel responsible for any issues arising from Supplier actions.

SUPPLIER TERMS AND CONDITIONS:

The client may be bound by the terms and conditions of individual Suppliers regarding cancellation penalties and other terms.

RISKS OF TRAVEL:

The client assumes responsibility for checking travel conditions and requirements.
COVID Risks: The client acknowledges and voluntarily assumes all risks related to exposure to COVID-19.

CHECK YOUR TRAVEL DOCUMENTS:

The client agrees to review travel documents for accuracy and is responsible for any change/cancellation penalties.

CREDIT CARDS:

Clients are encouraged to use credit cards for travel services.

Martello Travel acts as a facilitator; chargebacks should be directed to Suppliers.

TRAVEL INSURANCE:

Strongly recommended, but no assurance or promise is made about the insurance.

GOVERNMENT-ISSUED IDs:

The client must comply with TSA requirements for boarding flights, including the Real ID Act.

PASSPORTS AND VISAS:

The client must have a valid passport and may need visas for international travel.

FEE STRUCTURE:

Martello Travel charges fees based on the complexity and length of the trip.

Fees are non-refundable.

NO WARRANTIES:

The website and its features are provided “as is” without warranties.

LIMITATION OF LIABILITY:

Martello Travel is not liable for direct, indirect, or consequential damages arising from the use of the website's content or features.

CLAIMS DEADLINE, GOVERNING LAW, and EXCLUSIVE FORUM:

Claims must be presented within 30 days after the trip ends.

The agreement is governed by the laws of Washington state, with exclusive jurisdiction in Washington state courts.

AUTHORITY TO AGREE:

The person signing any of our forms affirms the authority to agree on behalf of everyone in their party or family.
